UNITED STATES PATENTS FOR CITIZENS OF OTHER COUNTRIES
Patent laws in the United States of America treat all inventors the same without regard to citizenship. In my practice, I handle United States filings and prosecutions for clients around the world.
Here are some options, under United States law, which are open for citizens of any country:
File an application in the United States before filing in any other country. (Please check whether that is legal under your own country's laws.)
File an application in the United States of America within twelve months of first filing in another country which is a member of the Paris Convention for the Protection of Industrial Property. Most countries are members. Those countries are listed below.
File an application in the United States of America as the National Phase of an International Patent Application under the Patent Cooperation Treaty. This must be done within the time limits provided by law.
